1. Services We Provide

ShonkuWeb delivers end-to-end technology development and management solutions for SMBs, including website design and development, iOS and Android application development, AI customer support and automation, as well as technical deployment, hosting, and proactive maintenance. Each engagement is governed by a written proposal, quotation, or master service agreement that defines the exact scope.

2. Project Engagement & Process

• Projects begin only after proposal approval and receipt of the initial payment, when applicable.
• Timeline estimates depend on timely client feedback, assets, and access credentials.
• Clients must supply all necessary copy, branding, imagery, and environment access.
• Delays in client deliverables extend the agreed delivery schedule.

3. Payments & Refunds

• Payment milestones follow the schedule defined within the project proposal.
• All payments are non-refundable unless ShonkuWeb fails to initiate work as agreed.
• Maintenance, hosting, or subscription fees are due on or before their billing date.
• Late or missed payments may lead to service, hosting, or support suspension.

4. Revisions & Changes

• Each engagement includes a specific number of revisions noted in the proposal.
• Additional revisions or out-of-scope changes incur separate charges.
• Major feature additions, redesigns, or new functionality are quoted as new work.

5. Intellectual Property Rights

After full payment, final deliverables—including websites, apps, UI/UX designs, and source code—become the client’s property, unless otherwise specified. ShonkuWeb may feature completed work in portfolios, case studies, or marketing unless the client restricts this in writing. Third-party tools, libraries, or assets remain bound by their original licenses.

6. Client Responsibilities

• Provide accurate information, brand guidelines, and approved content.
• Review and sign off on wireframes, designs, and builds promptly.
• Ensure supplied content respects copyright, privacy, and legal standards.
• Maintain secure control of user accounts, credentials, and platforms.

7. Hosting, Deployment & Maintenance

Hosting and infrastructure costs are separate unless bundled in a managed plan. ShonkuWeb is not liable for downtime or incidents caused by third-party registrars, hosting vendors, or APIs. Maintenance and ongoing updates are available exclusively to clients subscribed to a maintenance plan.

8. AI Customer Support & Automation Services

• AI system performance depends on the provided training data, business logic, and external APIs.
• Outputs may not be perfect; human oversight remains essential.
• Clients are responsible for compliance with privacy laws and platform policies (WhatsApp, Meta, etc.).

9. Data Privacy & Security

We apply industry-standard safeguards but cannot guarantee absolute protection against cyber threats. ShonkuWeb never sells or shares client data except when needed to deliver services (e.g., hosting partners). Clients must secure their customer data and follow applicable regulations.

10. Third-Party Services

Projects may include integrations with payment gateways, APIs, hosting providers, messaging platforms, or app stores. ShonkuWeb is not responsible for downtime, policy changes, or limitations introduced by these third parties.

11. Limitation of Liability

• No liability for indirect, consequential, or business losses.
• No responsibility for issues triggered by third-party tools or hosting vendors.
• No liability for delays arising from client-side communication gaps.
• No coverage for errors stemming from client or third-party modifications post-delivery.

Total liability for any project is capped at the amount paid for that specific engagement.

12. Termination

We may suspend or terminate services if payments lapse, terms are breached, or misuse/illegal activity is detected. Upon termination, clients must settle all outstanding invoices immediately.

13. Governing Law

These Terms are governed by the laws of India, with disputes subject to the exclusive jurisdiction of courts located in Kolkata, West Bengal.

14. Updates to Terms

ShonkuWeb may update these Terms at any time. The latest version will always be posted here with the revised “Last Updated” date. Continued use of our services constitutes acceptance of the updated Terms.
